my husband got hurt on the job,he was sent to the there doc, he did not have the eye equipment to treat him so he was refured to the ER, they fixed him up, gave him eye drops and tylonol3, later had a drug test at work came back pos, for a opioid (morphine) well he all most lost his job marrage ,daughter in the army and were are the short term care for the grand babies we could never get them etc, well the nurse at there docs offices were they did the test kept telling his boss he had to had taken the morphen, well if she was such a good nurse she would of known tylnol 3 is a opiod base and will show a false pos for morphen

    What is the question? What are the grounds of the lawsuit? He did not lose his job, he obviously did not lose his family. Be lucky he still has his sight, his job and family! If you are so upset, have a talk with the doctor that employs the nurse.

    This is really a legal question regarding the relationship between your husband and his employer, not a medical issue.

    For drug tests, if you have a prescription medication, that should be noted and is a valid explanation for popping up positive.

    Drug screens rarely test for specific drugs, but rather for classes of drugs. He should have been positive for opiates (the class of drugs which include morphine, codeine, and others) if he was taking Tylenol #3.

    Depending on his job, taking Tylenol #3 might have precluded him from doing his regular duties, and his boss should have been made aware of this and given him alternative work.

    Find a workmen’s comp lawyer. If they can’t help you, they might know who can.
